Is every nonprofit hospital required to have charity care?

Quick answer with a boundary
“Nonprofit” is not, by itself, the federal test for every charge. Federal financial-assistance requirements under section 501(r) concern hospital facilities operated by tax-exempt section 501(c)(3) organizations. A facility bill and a bill from an independently billing clinician, laboratory, or imaging group can therefore call for separate questions.
Try this as a three-column question card:
| Ask | Why it matters | Record |
|---|---|---|
| Is this a covered hospital facility? | It identifies whether the facility’s policy is relevant. | Department and written reply |
| Which services and billers are included? | A policy may define its own scope. | Names shown on statements |
| Where is the current application? | It provides the official instructions. | Link or paper-copy request |
Suggested message: “Please identify whether this hospital facility has a financial assistance policy, send the current policy and plain-language summary, and explain which billing entities are covered.”
The IRS overview of section 501(r) hospital requirements describes required policy topics for covered facilities. Its rules do not mean every service is free, that every nonprofit organization operates a covered facility, or that an application will be approved.
A useful next decision
If two statements have different biller names, make a separate request for each before assuming one answer controls both. Keep the question limited to policy availability and covered entities; there is no need to post account numbers, addresses, or other sensitive details. If staff give an oral answer, ask where it can be confirmed in writing. That written record can help distinguish a general description of a program from the terms that apply to a particular bill.
